A driver has one prior conviction for violating an out-of-service order while operating a 24-passenger shuttle bus (including the driver). Three years later, the same driver is convicted again of violating an OOS order while operating the same type of vehicle. What disqualification period applies under 49 CFR 383.51(e)?

Why This Matters
A second OOS order violation within 10 years on a passenger-rated vehicle jumps straight to a 3-to-5-year disqualification, there's no leniency for 'I didn't realize it still counted.' Any employer running your PSP report during that window will see both convictions and the dates, which makes repeat OOS violations a near-permanent mark on your hireability as a passenger-carrier driver.
